Class Action Against American Resorts International, Ltd. and American Resorts International's Holiday Network, Ltd.

To:  All current and former members of American Resorts International’s Holiday Network timeshare program from whom American Resorts sought and collected the charge for alleged service improvements or the charge for alleged fire prevention equipment described below.

The plaintiff filed this lawsuit against American Resorts on behalf of the group of people described above -- the Class -- charging that American Resorts breached its contract with its members, and violated the Illinois Consumer Fraud Act.  

Plaintiff claims that American Resorts breached its contract with members and violated the Illinois Consumer Fraud Act by charging members for alleged service improvements in August, 1999, and by charging members for alleged fire prevention equipment before that, even though the terms and conditions of membership in the Holiday Network did not allow American Resorts to collect money from the members for these things in addition to its members’ annual assessments. 

Plaintiff also claims that American Resorts did not use the money it collected for what it said it was collecting it for, and that it coerced people into paying the charges by threatening to cancel peoples’ memberships if they did not pay the charges that American Resorts demanded.
